Terms of use

To enter into a Purchase Agreement on acana-orijen.lv, please read and accept the terms and conditions of KOMEKS SIA, single Reg.No. 40103103167 (hereinafter – acana-orijen.lv): 

1. The sale of goods offered by acana-orijen.lv is carried out through an offer placed on the Internet, in accordance with Section 10 of the Consumer Rights Protection Law of the Republic of Latvia – when the Buyer places an order, Distance Contracts are concluded between the Buyer and the Seller. 

2. You can place an order on www.acana-orijen.lv or at the store at 155 Brivibas Street, Riga, or by phone +371 67 339 536

3. You can pay for the ordered goods using non-cash payments, which are technically enabled on acana-orijen.lv or by bank transfer.

4. When placing an order, you need to provide an email address so that the Buyer can receive instructions, invoice, delivery note and other necessary documentation.

5. When ordering an item – the Buyer can choose how to receive the item:

• receive the item by courier (DPD, DPD Pickup)
• get the item at Post points by Omniva.
  

6. Receive the ordered item within three business days of receiving the delivery notice.

7. If an instruction manual is provided for the item, it will be attached to the shipped item or, upon agreement with the Buyer, sent electronically to e-mail.

8. Before using the purchased item, please use the item only in accordance with the manufacturer’s instructions, according to the nature of the item and its intended use. 

9. If you change your mind and decide to withdraw from your purchase, the Consumer Rights Protection Law of the Republic of Latvia (CRPL) and Cabinet of Ministers Regulation No.255 “Regulations Regarding Distance Contracts” (Cabinet Regulation No.255) provide that the Buyer has the right to withdraw from the contract within 14 days and return the item purchased from the online store to the Seller. Section 12, Para 6 of the CRPL states that, upon withdrawing from a Distance Contract, “the consumer shall be responsible for maintaining the quality and safety of the product for the duration of the right of withdrawal”. We recommend that you keep the original packaging of the item in order to avoid exterior mechanical damage when exercising the right of withdrawal in accordance with the terms of the Distance Contract. To arrange the return of the item, please fill out the Withdrawal Form and contact us by e-mail: komeks@komeks.lv or by phone: +371 67 339 536, stating the order number and date. You can return the item by delivering it to the store in Riga, 155 Brivibass Street, or sending the item together with the Withdrawal Form.

10. Procedures for resolving complaints and out-of-court disputes.

11. A complaint about the availability or quality of goods shall be submitted electronically by sending an e-mail to komeks@komeks.lv or writing to 155 Brivibas Street, Riga, LV-1012. Complaints will be processed within 7 business days of the date of receipt of the complaint, by sending a reply to the contact address specified in the complaint.

12. If the complaint is determined to be unfounded and the Buyer does not agree to the complaint being declared unfounded, the Buyer has the right to use the alternative dispute resolution rights established by laws and regulations by submitting a written application to the Seller of the item regarding out-of-court resolution of the dispute, stating:

• full name, contact information
• the date of submission of the complaint
• the nature of the dispute, the claims and the grounds on which they are based.

13. In compliance with the legislation of the Republic of Latvia, KOMEKS SIA maintains the purchase agreements with its customers to the extent necessary for accounting.

14. Marketing activities:

• acana-orijen.lv is free to initiate various marketing activities, incl. loyalty programs
• By registering or making purchases in the acana-orijen.lv online store, the Buyer may be registered for receiving news and information messages via email. Cancellation options: according to the procedure stated in the acana-orijen.lv online store or by e-mail komeks@komeks.lv

15. Purchases shall not be subject to any additional charges for execution and delivery unless specifically agreed with the Buyer (for example, non-standard size or delivery times).

16. acana-orijen.lv reserves the right not to service the order if it fails to contact the customer by the telephone or email provided by the customer.

What is the right of withdrawal and when can it be exercised?

1. Entering into a distance contract, i.e. making a purchase through the acana-orijen.lv online store, you may exercise the right of withdrawal and unilaterally withdraw from the contract within 14 days of receipt of the goods. The right of withdrawal shall not apply to legal persons.

2. The period for executing the right of withdrawal shall be calculated as follows:

• if goods are purchased – from the day when the consumer has obtained possession of the goods;
• if a consumer in one order has ordered several goods which are supplied separately – from the day when the consumer has obtained possession of the last goods;
• if goods are delivered which consist of several lots or parts – from the day when the consumer has obtained possession of the last lot or part of the goods.
  

3. You have the right to try the goods in question during the exercise of the right of withdrawal to make sure it meets your needs and preferences Remember! During the period for executing the right of withdrawal you have the right to use the goods to the extent necessary for trying out the goods (to the same extent as would be possible before purchasing the goods in a regular store).

4. By using the right of withdrawal, you are responsible for using the goods beyond the intended purpose of the goods, for use of the goods during the term of exercise of the right of withdrawal, which is incompatible with the principle of good faith, as well as the reduction of the value, quality and safety of the goods.

5. At the time of selling or ordering the goods, the acana-orijen.lv online store shall send you the withdrawal form to your e-mail address with the name and address of the Seller and a description of the right of withdrawal.

6. You can request the withdrawal form electronically by sending an e-mail to komeks@komeks.lv 

7. You are required to return the goods to the Seller within 14 days of sending the withdrawal form. You must provide packaging for transportation when returning the goods to the Seller.

8. If you exercise the right of withdrawal and this is not due to the non-compliance of the goods or service in question with the terms of the contract, then you are responsible for bearing the cost of returning the goods.

9. If you exercise the right of withdrawal, the acana-orijen.lv online store is obliged to refund you any deposits you have made as soon as possible, but no later than 14 calendar days from the date of your written withdrawal. The acana-orijen.lv online store refunds only to the bank account indicated on the withdrawal form.

10. To exercise the right of withdrawal, you may return the goods by delivering them to the acana-orijen.lv store in Riga, 155 Brīvības Street, or sending the goods via “Latvijas Pasts” together with the withdrawal form. Upon returning the goods to the “Latvijas Pasts” offices, appropriate transport packaging must be provided – the original packaging of the goods must be packed in another transport packaging.
